Rules for the purchase and sale of goods in the www.herownalone.com online store

General provisions
1.1. These rules for the purchase and sale of goods (the “Rules”) set out the general terms for purchasing goods in the HerOwnAlone online store operating on the website www.herownalone.com (“HerOwnAlone”).
1.2. The HerOwnAlone store is controlled, and goods in it are sold, by MB Ecommerce solutions, legal entity code 306626099, correspondence address Baltųjų Garnių g. 5, Toliūnų k., Ukmergės r. (the “Seller”).
1.3. The Buyer is a person purchasing goods from HerOwnAlone. Goods at HerOwnAlone may be purchased by legally capable adult natural persons and by legal entities acting through their authorised representatives.
1.4. By registering or placing an order, the Buyer unconditionally confirms that they meet the conditions set out in clause 1.3 and are entitled to purchase in the HerOwnAlone store.
1.5. Personal data — the Buyer's personal data which the Buyer voluntarily provides when registering and/or ordering goods in the HerOwnAlone store. Personal data also includes the Buyer's purchase history, where such data is stored in accordance with the requirements of the legislation of the Republic of Lithuania. If the recipient of the goods is a person other than the Buyer, the Buyer must ensure that the recipient's personal data is provided lawfully.
1.6. Rules — these purchase rules of the www.herownalone.com online store. These online store purchase rules establish the mutual rights, obligations and responsibilities of the Buyer purchasing goods at www.herownalone.com and the Seller when purchasing goods in the online store.

General provisions.
2.1. These Rules are a legal document binding on the Parties, setting out the rights, obligations and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the HerOwnAlone online store. The Buyer concludes the purchase agreement by accepting these rules. The agreement is deemed concluded when the Buyer forms and submits an order for goods in the HerOwnAlone store, makes payment in the manner and within the time limits set out in the Rules (where the Buyer has chosen to pay for the goods at the time of ordering), and HerOwnAlone sends confirmation to the email address specified by the Buyer that the Buyer's order has been accepted.
1.7. The Seller reserves the right to change, amend or supplement the rules at any time, taking into account the requirements established by law. When the Buyer shops in the HerOwnAlone online store, the Rules in force at the time the order is placed apply, so the Buyer is recommended to review the Rules each time they shop.
1.8. The Buyer is unable to place an order for goods in the HerOwnAlone online store if they have not read the Rules or do not agree with them. The Seller assumes no responsibility or risk if the Buyer has partially or fully failed to read the Rules, even though such an opportunity was provided.
1.9. The Seller confirms that it is responsible for the sale of goods ordered in the HerOwnAlone online store and for the proper delivery of purchased goods, the quality of the goods, the proper fulfilment of the return conditions, and the implementation of other rights and obligations of the seller provided for in law.
1.10. The Seller has the right, without warning, to restrict the Buyer's use of the HerOwnAlone store services or to cancel the Buyer's registration if the Buyer uses the HerOwnAlone store in breach of these Rules or attempts to harm the stability and/or security of the HerOwnAlone store's orders and operation.

Registration and processing of personal data
2.1. . The Buyer can order goods in the HerOwnAlone online store:
2.1.1. by registering in this HerOwnAlone online store — entering the data requested during registration;
2.1.2. without registering in this online store.
2.2. When ordering goods in the ways set out in clause 2.1 of the rules, the Buyer must provide, in the relevant information fields supplied by the Seller, the Buyer's (or the recipient's) personal data necessary for the proper fulfilment of the order: name, surname, delivery address, telephone number and email address.
2.3. By accepting these rules, the Buyer agrees that the Buyer's personal data provided in clause 2.2 will be processed for the purposes of purchasing and delivering goods to the Buyer and for accounting purposes. The recipient's data will be provided to the person carrying out delivery solely for the purpose of fulfilling the agreement with the Buyer. Marketing offers will be provided to the Buyer only with their separate consent. 2.4. The Buyer has the right at any time to freely change, supplement or delete their registration data.
2.5. When registering, the Buyer creates individual login credentials (a username and password) and undertakes to keep them secret and not disclose them to any third parties. To reduce the risk of unauthorised access to the HerOwnAlone store in the Buyer's name, it is recommended to create a complex, hard-to-guess password (it is recommended that the password consist of at least 8 characters, using uppercase and lowercase letters, numbers and punctuation marks, avoiding easily guessable words (the Buyer's first name, surname, etc.) and/or numbers (e.g. date of birth), etc.) and to change it at least every 6 (six) months. The Buyer is responsible for the complexity and safekeeping of the login credentials they create, as well as for any actions (data transfer, orders placed, user comments, etc.) carried out in the HerOwnAlone store after logging in with the Buyer's individual username and password. If a third party uses the services provided by HerOwnAlone after logging in to the online store using the Buyer's login credentials, the Seller treats that person as the Buyer. If the Buyer loses their login credentials, they must immediately inform the Seller by post, telephone or email, or change the login credentials by logging in to the HerOwnAlone store system. The Seller cannot be and will not be held liable for damage caused to the Buyer when third parties log in to the HerOwnAlone store using the Buyer's login credentials. The security of login credentials is especially important in the case of payments by debit or credit card.
2.6. The Buyer's personal data will be processed in accordance with the Privacy Policy (https://herownalone.com/pages/privatumo-politika). If the Buyer uses the HerOwnAlone store services, they are deemed to consent to the processing of the Buyer's personal data and confirm that all information and personal data provided is correct and true.
2.7. Additionally, whether or not registering an account, the Buyer may provide their email address, to which the Seller would send the Buyer newsletters or other product offers. The Buyer may withdraw this consent at any time by clicking the link provided in the newsletter or by informing the Seller directly by email (for more, the Privacy Policy (https://herownalone.com/pages/privatumo-politika).

Prices of goods, payment procedure and deadlines
3.1. Prices of goods in the HerOwnAlone store and in the order formed are given in Euros including VAT. Goods are sold to the Buyer at the prices in force in the HerOwnAlone store at the moment the order is placed.
3.2. The Buyer can pay for the goods in one of the following ways:
3.2.1. Payment using electronic banking — this is advance payment using the electronic banking system used by the Buyer. To use this payment method, the Buyer must have signed an electronic banking agreement with a bank. The Buyer transfers the money to the online store's settlement account. When using this payment method, the payment order must be confirmed no later than 3 (three) hours after the order is submitted to the Seller and the payment order is formed. Payment is deemed completed when the Bank confirms to the Seller that the payment order has been executed successfully. Responsibility for data security during the Buyer's payment in this case lies with the specific bank, since all monetary operations take place in the bank's electronic banking system.
3.2.2. payment by bank transfer — this is advance payment where the Buyer transfers the money to the settlement account specified by the Seller. The Buyer undertakes to pay by advance bank transfer no later than 2 (two) days from the moment the order is submitted in the Online store. Payment is deemed completed when the amount payable is credited to the Seller's bank account. Responsibility for data security during the Buyer's payment in this case lies with the specific bank, since all monetary operations take place in the bank's electronic banking system.
3.2.3. payment in cash or by card on delivery via courier — this is payment where the Buyer pays the money to the courier delivering the parcel.
3.2.4. payment in cash or by card on delivery at a parcel locker — this is payment where the Buyer pays the money when collecting the parcel at the parcel locker.
3.3. The Buyer undertakes to pay for the goods immediately. Only after payment for the goods is received does the formation of the parcel begin and the delivery period start to be counted, except where the Buyer chooses the cash or card payment to the courier or parcel locker method.
3.4. No later than 3 (three) business days after the goods are handed over to the Buyer, the Seller provides a VAT invoice, which is also stored in the Buyer's individual account in the online store.

Ordering and delivery of goods
4.1. In the online store, the Buyer can shop 24 hours a day, 7 days a week.
4.2. For courier delivery or delivery to parcel points, the rates in force at the time the order is placed apply, specified in the Online store menu section “Shipping” (https://herownalone.com/policies/shipping-policy). The delivery price applies to the entire ordered basket of goods and is not divided among individual items.
4.3. The Buyer can choose one of the specified delivery methods: receive the ordered goods by post, via courier to the address specified by the Buyer, or collect them at a parcel locker. If the order is paid for on a business day before 12:00, the goods are dispatched to the Buyer the same business day; if the order is paid for on a business day after 12:00 or on a non-business day, the order is dispatched to the Buyer the next business day, except where a different delivery period is specified on the product page — in which case dispatch takes place within the periods specified on the product page. The exact delivery time is agreed between the courier and the Buyer by telephone, with the courier calling the number specified by the Buyer, or an SMS notification is received about delivery to a parcel point or parcel locker.
4.4. The Buyer's ordered goods are delivered to the address specified during the Order. The Buyer who has chosen courier delivery undertakes to specify the exact delivery address and the desired delivery time in the Buyer's electronic purchase account and to collect the goods at the delivery time agreed with the courier. The Buyer must ensure that, at the delivery time agreed with the courier and at the delivery location provided during the order, the goods are collected by the buyer or another person to whom the buyer has passed the order number. By disclosing the order number to another person, the Buyer assumes responsibility and has no right to make claims against the Seller regarding delivery of the goods to an incorrect party. If delivery of the goods is impossible through no fault of the Seller (for example, the Buyer specified an incorrect address when ordering, the Buyer or recipient cannot be found at the specified address, etc.) or the Buyer does not collect the goods at the time agreed with the courier, the Seller may, without prior warning, terminate the purchase and sale agreement. If, in the case provided for in this clause, the Seller terminates the purchase and sale agreement, the Seller returns the amount paid for the goods to the Buyer within 14 days, deducting from that amount the delivery costs incurred by the Seller.
4.5. The Seller delivers the goods to the Buyer in accordance with the periods specified in the product descriptions. These periods are preliminary and, in addition, do not apply in cases where the required goods are not in the Seller's warehouse and the Buyer is informed of the shortage of the ordered goods. The Buyer also agrees that, in exceptional cases, delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery.
4.6. In all cases the Seller is released from liability for breach of the delivery periods if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Seller's control.
4.7. The Buyer must in all cases immediately inform the Seller if the parcel is delivered in crumpled or otherwise damaged packaging, if the parcel contains goods that were not ordered or an incorrect quantity, or if the product is incomplete.
4.8. When accepting the purchased goods, before signing the delivery documents, the Buyer must inspect the condition of the packaging, the quantity, quality and assortment of the goods. If the Buyer notices defects in the goods or discrepancies between the parcel and the order, the Buyer must not accept the parcel and must, together with the courier, complete a special parcel inspection report stating the defects found and inform the Seller about them at the telephone number or email address specified in these Rules. If the Buyer confirms the delivery documents without comment, the goods are deemed to have been delivered in undamaged packaging, and the quantity, quality and assortment of the goods comply with the order and the terms of the purchase and sale agreement.

Quality guarantee of goods and shelf life
5.1. . The details of the goods sold in the online store are specified in the product description next to each product.
5.2 The Seller is not responsible for the fact that the goods in the online store may not match the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.
5.3. If the goods are of poor quality at the time of delivery to the Buyer, the Seller undertakes to take back such goods and replace them with analogous suitable goods or to refund the money paid for the poor-quality goods. Defects of sold goods are remedied, and poor-quality goods are replaced and returned, in accordance with the Retail Trade Rules approved by Resolution No. 697 of the Government of the Republic of Lithuania of 11 June 2001 (current version) and the Civil Code of the Republic of Lithuania.

Withdrawal from the agreement. Exchange and return of goods
6.1. The Buyer has the right to withdraw from the purchase and sale agreement concluded in the HerOwnAlone online store by notifying HerOwnAlone in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods. Contact us by email at herownalone@gmail.com.
6.2. After submitting a written notice of withdrawal from the agreement, the Buyer must return the goods (if they were delivered) no later than 15 (fifteen) calendar days.
6.3. Pursuant to Article 6.228-10 of the Civil Code of the Republic of Lithuania, the Buyer has no right to return good-quality goods that the Buyer has used, damaged, unpacked, whose packaging the Buyer has broken, or that have lost their saleable appearance due to other actions of the Buyer, for health-protection or hygiene reasons, as well as goods made to the buyer's special instructions that are not pre-made and are produced taking into account the buyer's personal choice or instruction, or goods clearly adapted to the buyer's personal needs. 6.4. Goods are considered to be of poor quality if their shelf life has expired, if the goods contain components prohibited by law, if, due to improper storage conditions before the goods were handed over to the Buyer, the consistency or other essential characteristics of the goods have changed, if the goods are mechanically damaged, their packaging is damaged, or there are other quality defects.
6.5. Good-quality goods being returned or exchanged must be undamaged, unpacked, not having lost their saleable appearance (labels not removed or damaged, protective films not torn off, etc.) and unused. The goods must be returned in the original packaging, of the same configuration as received by the Buyer, necessarily presenting the proof of purchase, the instructions for use and other accessories of the product.
6.6. Goods may be transferred (returned) to the Seller by post or via courier. When the Buyer contacts the email address hello@herownalone.com/ detailed return instructions will be provided. For more about returning goods, see the Returns section (https://herownalone.com/policies/refund-policy).
6.7. The money paid for goods accepted by the Buyer but subsequently returned is paid into the Buyer's account no later than 14 (fourteen) days from the return of the goods. When returning or exchanging good-quality goods that match the Buyer's order, the delivery fee is refunded in proportion to the quantity of goods returned.

Final provisions
11.1. These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
11.2. The law of the Republic of Lithuania applies to relations arising on the basis of these Rules.
11.3. In the event of damage, the party at fault compensates the other party for direct losses in the manner and on the grounds established by the laws of the Republic of Lithuania.
11.4. All disagreements arising from the implementation of these Rules are resolved by negotiation. If agreement cannot be reached, disputes are resolved in the manner established by the laws of the Republic of Lithuania.
11.5. Each consumer also has the option to resolve disputes arising with HerOwnAlone electronically, without going to court. First, the consumer must contact HerOwnAlone in writing, and within 14 days of receiving the claim, if HerOwnAlone has not responded to the consumer's claim or has not satisfied it, the consumer may apply to the body that handles consumer disputes out of court, i.e. the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email tarnyba@vvtat.lt, tel. 852626751, website www.vvtat.lt), or to its territorial divisions in the counties, or fill in the application form on the EGS platform http://ec.europa.eu/ods/).
